WHEREAS, on June 30, 2017, by Deed of Trust in the Register's Office of Dickson County, Tennessee, in Volume 1298, Page 849, RIKI JONES, unmarried, conveyed to RAMSEY THORNTON BARRETT OSBORN, PLC, Trustee, the hereinafter described real estate to secure the payment of promissory note of even date therewith payable to the order of ROBERT T. DONEGAN, in the original principal amount of $65,500.00; and WHEREAS, default has been made in the payment of said indebtedness and other provisions of the Deed of Trust have been violated, and ROBERT T. BEGINNING on the northwest corner of the lot herein conveyed at the intersection of Spring Street and Hunt Street; running thence southward with Spring Street, 150 feet to an alley; thence with said alley, eastward 165 feet to a stake; thence North 150 feet to Hunt Street; thence westward with Hunt Street, 165 feet to the beginning corner.

Being the same property conveyed to Riki Jones, unmarried, by deed from Zane L. Cole, Trustee of the Cole Living Trust, dated June 29, 2017, of record in Volume 1298, Page 847, in the Register’s Office of Dickson County, Tennessee.

This is an attempt to collect a debt, and any information obtained will be used for that purpose.

Said sale will be subject to all unpaid taxes, and governmental zoning and subdivision ordinances in effect on the day of sale, and to any restrictions, easements and other encumbrances of record, and other superior matters of record which may affect said property; as well as any prior liens or encumbrances as well as priority created by a fixture filing; and/or any matter that an accurate survey of the premises might disclose.

Said Deed of Trust recites title as unencumbered, except as noted herein, but sale will be made as Substitute Trustee only, without covenants of seizin or warranties of title.

The sale will be conducted subject to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and to final confirmation and audit of the status of the loan with the holder of the Deed of Trust.

The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above.

The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the Substitute Trustee, be cause for rejection of the bid, and if the bid is rejected, the Substitute Trustee shall have the option of making the sale to the next highest bidder who is ready willing, and able to comply with the terms thereof. The proceeds derived from the sale of the property will be applied as provided in said Deed of Trust.  Announcement made on the day of the sale will supersede the terms and provisions of any printed announcement of sale.

TRUSTEE‘S NOTICE OF SALE OF REALTY

PURSUANT TO  DEED OF TRUST

WHEREAS, WILLIAM A. SPANN and wife, MARTY SPANN, having heretofore made a Deed of Trust to Volunteer Title Company, Incorporated, Trustee, of record in Volume V1389, page 277, as modified and amended by Modification and Amendment to Deed of Trust of record in Volume V1456, page 371, Register’s Office of Dickson County, Tennessee, to secure the payment of an indebtedness owing to Waverly Wood, LLC, in the original amount as stated therein by mortgaging the real estate described therein; and
