NOTICE OF DICKSON COUNTY SHERIFF’S SALE OF REAL ESTATE

WHEREAS, in the cause of Team Title, Inc. and Malek Yafal, Plaintiffs v. Stacey Vance and Al Vance, Defendants, Civil Action No. 17-1376-II, by order of the Chancery Court of Davidson County, Tennessee dated August 21, 2018 (Judgment), a judgment was granted to the Plaintiffs against the Defendants in the amount of Seven Thousand Nine Hundred and Seventy-Seven Dollars ($7,977.00).  The Judgment is of record in the Dickson County Register of Deeds in Volume 1355, Page 191.  

WHEREAS, by further order of the Chancery Court of Davidson County, Tennessee, dated September 4, 2019, the Court commanded me, the Dickson County Sheriff, pursuant to Tenn. R. Civ. P. 69.07(4) to sell the real property to pay the amounts owing under the Judgment together with such other and further sums allowed and directed by the Court in said order; 

WHEREAS, by additional order of the Chancery Court of Dickson County, Tennessee, in the cause of Team Title Inc. and Malek Yafal v. In rem: The Real Property On Estes Rd Map/Parcel No. 056 052.06, Civil Action No. 2018-CV-407, the Court commanded me, the Dickson County Sheriff, pursuant to Tenn. R. Civ. P. 69.07(4) to sell the real property to satisfy the Plaintiffs’ judgment from the Davidson County Chancery Court in the principal amount of $7,977.00 and legal fees in the amount of $2,500.00 plus interest and court costs; wherefore, 

THE PUBLIC IS HEREBY NOTIFIED, that pursuant to the command of the Chancery Court of Davidson County, Tennessee as aforesaid, I, the Dickson County Sheriff, will at 10:00 a.m., central standard time, on Tuesday, March, 3, 2020, sell at public outcry and auction at the front door of the Dickson County Courthouse Annex in Charlotte, Dickson County, Tennessee the real property hereinafter described and being located generally on Estes Road in Charlotte, Tennessee (the Property).  The Property will be sold, inter alia, to (a) all defects in title having priority or preference over the lien of the Judgment, (b) all applicable and enforceable laws of governmental authorities having jurisdiction over the Property, whether or not such matters are disclosed by the public records of Dickson County, Tennessee, wherein the Property is located, and (c) all encumbrances as noted of record in the Dickson County Register of Deeds. The Property will be sold for cash to the highest and best bidder and in bar of right and/or equity of redemption.  If the highest bidder does not pay the successful bid price within twenty-four (24) hours of the conclusion of the sale the same will be offered to the next highest bidder who is ready, willing, and able to purchase the Property for cash. 

The Property is described in the instrument most recently of record in the Dickson County Register of Deeds Office as follows: 

Lying and being in the Sixth Civil District of Dickson County, State of Tennessee and being Tract 7 on the Final Plat of Estes Development, Highway 48N/Charlotte, Tennessee, of record in Plat Cabinet G, Slide 262-263, in the Register's Office of Dickson County, State of Tennessee, to which plat reference is hereby made for a more complete description. 

Being the same property conveyed to Stacey Vance, married, by deed from David Cochran and wife, Shanna Cochran, dated November 11, 2014, and of record in Volume 1205, Page 228, in the Register's Office of Dickson County, State of Tennessee.

It appears that the property has not been assigned a street address and that the property is unimproved and/or vacant land. 

The Property is identified as Parcel 056 Map 052.06 in the Dickson County Property Assessor’s Office. 

The sale may be adjourned to another time and place without further publication by announcing such adjournment at the time of the sale and said process from time to time may be repeated until the Property is sold by me or until the expiration of one (1) year following the originally scheduled date of sale, whichever occurs sooner. 

The sale may be cancelled at the request of the Plaintiff and re-advertised for sale at a later date without diminishing, impairing, or otherwise affecting the priority of the Judgment as a lien on the Property. 

The owner of record of the Property is Stacey Vance and Al Vance.  The last known mailing address for the Plaintiffs is 1265 Grouse Court, Fairbanks, Alaska 99709. 

There is no record holder of a mortgage, deed of trust, or other lien which will be extinguished or adversely affected by the sale of the Property, nor is there any mortgage, deed of trust, or lien nor notice or evidence thereof which has been recorded in the public records of Dickson County, Tennessee, more than ten (10) days prior to the first advertisement of this notice of sale except as may have been filed by the State of Tennessee or the Federal Government. 

I, the Dickson County Sheriff, am unaware of any other party whose rights will be adversely affected by the sale of the Property pursuant to this notice.
