NOTICE OF SALE OF REAL ESTATE

WHEREAS, by deed of trust dated March 12, 2001, of record in Volume 613 at page 252 in the Register's Office of Dickson County, Tennessee (the "Deed of Trust"), Ewing Felts (the “Grantor”) conveyed the hereinafter-described real estate (the "Property") to FMLS, Inc., Trustee, to secure the payment of the indebtedness due under a credit agreement of even date therewith between the Grantor and AmSouth Bank (the "Credit Agreement"); and

WHEREAS, by instrument dated December 15, 2005, of record in Volume 883 at page 122 in the Register’s Office of Dickson County, Tennessee, the Credit Agreement and Deed of Trust were assigned to First Federal Bank; and

WHEREAS, by instrument dated March 24, 2021, of record in Volume 1500 at page 398 in the Register’s Office of Dickson County, Tennessee, Barney B. Regen was appointed substitute trustee under the Deed of Trust (the “Substitute Trustee”); and

WHEREAS, default has occurred in the payment of the secured indebtedness and other provisions of the Deed of Trust have been violated, and First Federal Bank, the owner and holder of the indebtedness due under the Credit Agreement, has declared the entire indebtedness due and payable, and has directed the Substitute Trustee to foreclose the Deed of Trust in accordance with the terms thereof;

THE PUBLIC IS HEREBY NOTIFIED that the Substitute Trustee will sell the Property at public auction to the highest and best bidder for cash at the front door of the Dickson County Courthouse Annex in Charlotte, Tennessee, at the hour of 3:00 p.m. prevailing central time on Friday, May 21, 2021, in bar of the Grantor’s right and equity of redemption, and subject to all liens, encumbrances, and other defects in title having priority or preference over the Deed of Trust; to the rights of tenants in possession (if any); and to all applicable and enforceable laws of governmental authorities having jurisdiction of the Property, whether or not such matters are disclosed by the public records of the county wherein the Property is located.

The Property is described in the Deed of Trust as follows:

First Tract: Beginning at a stake at Carney Davidson’s southeast corner and Newt Brooks’ northeast corner at the edge of the Barton’s Creek Road; runs Westwardly with Carney Davidson’s line 165 feet to a stake; thence Southwardly 39 feet to a stake in a fence row; thence Eastwardly 165 feet with the fence row to a stake at the edge of the Barton’s Creek Road; thence with said road Northwardly 39 feet to the beginning.

Second Tract: Beginning at a stake at Leland Bateman’s southeast corner at the Barton Creek Road; runs thence Westwardly with Bateman’s line 10 poles to a stake; thence Southwardly, a new line, eight (8) poles to a stake; thence Eastwardly, another new line, 10 poles to the Barton Creek Road; thence Northwardly with said road eight (8) poles to the point of beginning.

Being the same property conveyed to Ewing Felts, a single man, by deed from Eluie Crews and wife, Louise E. Crews, dated September 27, 1977, and of record in Volume No. 75, page 13 in the Register’s Office of Dickson County, Tennessee.

On May 26, 1978, by warranty deed of record in Volume 83 at page 292 in the Register’s Office of Dickson County, Tennessee, Ewing Felts conveyed the Property to Kenneth G. Page and wife, Debbie G. Page, and on March 19, 1983, by warranty deed of record in Volume 142 at page 237 in said register’s office, Kenneth Page and wife, Debbie Page, conveyed the Property to Ewing Felts and wife, Ruth Felts. Ruth Felts died on February 18, 1992.

Although not set forth in the Deed of Trust, the Property is believed to be situated in the Sixth Civil District of Dickson County, Tennessee.

The street address of the Property is believed to be 1315 Big Barton’s Creek Road, Dickson, Tennessee, but such address is not part of the legal description by which the Property will be sold, and in the event of a discrepancy between the legal description and the street address, the legal description will control.

The Property is believed to be identified as Map 055-00-005.00 on the Dickson County tax map.

The Property is believed to be improved.

The right is reserved to adjourn the sale of the Property to another time and place without further publication upon announcement of such adjournment at the time and place set for the sale above; to adjourn the sale of the Property to another time and place without further publication upon announcement of such adjournment at the time and place set for the adjourned sale; and to repeat this process from time to time until the Property is sold by the Substitute Trustee, or until the expiration of one (1) year following the originally scheduled date of sale, whichever occurs first

The right is reserved to cancel the sale of the Property at the request of the secured creditor, and to re-advertise the Property for sale at a later date, without diminishing, impairing, or otherwise affecting the priority of the Deed of Trust as a lien on the Property.

If the highest bidder does not pay the bid price within twenty-four (24) hours of the sale, the right is reserved to sell the Property to the next highest bidder who is ready, willing, and able to purchase the Property for cash.

The record owners of the Property are Ewing Felts and wife, Ruth Felts.

There is no record holder of any mortgage, deed of trust, or other lien which will be extinguished or adversely affected by the sale of the Property, and which mortgage, deed of trust, or lien, or notice or evidence thereof, was recorded in the public records of Dickson County, Tennessee, more than ten (10) days prior to the first advertisement or notice of sale.

The Substitute Trustee is unaware of any other party whose rights will be adversely affected by the sale of the Property pursuant to this notice.

The Substitute Trustee is considered a debt collector within the meaning of the Fair Debt Collection Practices Act. Accordingly, this notice is from a debt collector attempting to collect a debt and any information obtained will be used for that purpose.

Dickson Housing Authority is accepting bids for stripping

and painting metal rails and also accepting bids

for stripping and painting metal posts. Job speci cations

are available at the Dickson Housing Authority

Administrative o ce located at 333 Martin L. King

Jr. Drive, Dickson, TN 37055. Contractors must be

licensed and insured. Davis Bacon wage rates apply.

will be accepted until 2:00 p.m., Friday, May 21, 2021.

INVITATION TO BID

The City of Dickson, Tennessee invites you to submit bids for providing all labor,

materials and equipment required to execute the Work described in the Drawings and

Specifications entitled Renovations and Improvements for the Dickson Senior Activity

Center, 100 Payne Springs Road, Dickson TN 37055 and dated April 28, 2021.

The Work to be performed consists of general construction including mechanical,

plumbing and electrical construction for renovations to an existing building of

approximately 16,000 square feet.

A pre-bid conference will be held at the site of 100 Payne Springs Road, Dickson TN,

on May 20, 2021 at 9:00 a.m. Representatives of the General Contractors, major subcontractors

and others having an interest in this project are invited and urged to attend.

Bids will be accepted until 2:00 p.m. Central Standard Time on Friday, June 18, 2021

at which time they will be opened and read aloud in the Council Chambers at Dickson

City Hall, 600 East Walnut Street, Dickson TN.

Copies of the Bidding Documents may be obtained from the Office of Planning and

Zoning beginning May 5, 2021 during regular business hours. General Contractors

will be issued two (2) sets of Bidding Documents. All sets of Bidding Documents shall

be returned to the owner at the time of bid. Coordinate review of bidding Documents

and all access to the construction site with Mr. Jason Pilkinton, Director of Planning

and Zoning and Mr. Andy Bowker, Building Official. All questions relative to the

project shall be directed to Mr. Jason Pilkinton and Mr. Andy Bowker. Telephone

No bid may be withdrawn for a period of forty-five (45) days after the bid date. The

Owner reserves the right to reject any or all bids, to waive all informalities, and to

accept any bid on any basis the Owner deems necessary. Bid security will be required.
